When You Need a Patent Valuation
- licensing — setting the economic basis for royalty-bearing license agreements;
- contribution in kind — patent rights contributed to the charter (share) capital of a company;
- sale or assignment of patent rights;
- collateral — intellectual property pledged to secure financing;
- IFRS financial reporting — fair value of intangibles for audit purposes;
- litigation — infringement damages and lost profits claims.
What We Value
The subject of valuation is the bundle of property rights attached to a registered invention: the patent itself, its claims, the maintenance-fee record, existing licenses and the actual use of the technology. Utility models and industrial designs are covered by the same methodology — what differs is the term of protection and the evidence base. Remaining protection term, geography of registration (national filings or international applications under the Patent Cooperation Treaty), and how difficult the claims are to design around all feed directly into value. Where a valuation is required for statutory purposes in Ukraine, reports also comply with Ukrainian National Valuation Standard No. 4.
Methodology: Stage of Commercialization Decides
For technologies already in commercial use, the income approach is the primary basis: the relief-from-royalty method prices the licenses the owner would otherwise have to buy, while the profit-premium method capitalizes the measurable cost savings or price premium the invention delivers. For early-stage inventions that have not yet reached production, the cost approach applies by default — development, registration and readiness costs — because a revenue forecast for an unproven technology rarely survives scrutiny. The market approach plays a limited role: open transactions in patents are scarce.
The heart of every report is the supportability of the earnings forecast. Serial production, a working prototype, or a registered idea are three fundamentally different evidence bases, and the report must say honestly which one it stands on.

How much does a patent valuation cost? We quote a fixed fee and timeline after reviewing the registration documents, the stage of commercialization and the purpose of the valuation — both are agreed before the engagement letter is signed.
Do you assess patent validity or patentability? No. Validity and patentability opinions are the domain of patent attorneys and national IP offices. We determine the market value of the property rights on the basis of registration documents in force.
Can you value an invention that is not yet in production? Yes — by the cost approach as a default. An income-based valuation is used only where the earnings forecast is supportable and evidence-based.
Do you value patents registered outside Ukraine? Yes. We work for clients from any country and value patents with international protection; communication is in writing in English and the deliverable is an English-language report.
